Terms of Service

1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the iRestro website (irestro.com), tenant and admin dashboards (app.irestro.com), and the iRestro mobile app (together, the "Service"), operated by iRestro ("we", "us"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Description of Service
iRestro is a restaurant management platform providing point-of-sale, kitchen display, table and floor management, inventory, staff, and reporting tools for restaurant businesses, accessed through a web dashboard and a companion mobile app for staff.
3. Accounts & Eligibility
You must be at least 18 years old and authorized to act on behalf of the business you register to use the Service. You are responsible for the accuracy of the information you provide and for maintaining the confidentiality of your login credentials. You are responsible for all activity that occurs under your account, including accounts created for your staff.
4. Subscriptions & Billing
Access to certain features requires a paid subscription plan, as described on our Pricing page. Payments are processed through our payment partner, Fonepay. Subscriptions renew automatically for successive billing periods unless cancelled before the renewal date.
Fees are non-refundable except where required by law. We may change subscription pricing with reasonable advance notice; continued use after a price change takes effect constitutes acceptance of the new price.
If a subscription lapses or payment fails, we may suspend access to paid features until payment is resolved.
5. Your Business Data
You retain ownership of the business, menu, order, and staff data you input into the Service ("Your Data"). You grant us a license to host, process, and display Your Data solely to provide and improve the Service. You are responsible for the accuracy and legality of Your Data.
6. Acceptable Use
You agree not to: use the Service for any unlawful purpose; attempt to gain unauthorized access to the Service or other accounts; interfere with or disrupt the Service's operation; reverse engineer or copy the platform's software; or use the Service to process payments or transactions you are not legally authorized to process.
7. Intellectual Property
The iRestro platform, including its software, design, and branding, is owned by iRestro and protected by applicable intellectual property laws. Nothing in these Terms transfers ownership of the platform to you.
8. Third-Party Services
The Service integrates with third-party providers, including Google (for sign-in and push notifications) and Fonepay (for payment processing). Your use of those integrations is also subject to the respective third party's terms and privacy policy.
9. Service Availability
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation and may perform maintenance or updates that temporarily affect availability.
10. Limitation of Liability
To the maximum extent permitted by law, iRestro is not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the subscription fees you paid in the three months preceding the claim.
11. Termination
You may cancel your subscription at any time from the dashboard. We may suspend or terminate your access for breach of these Terms or non-payment. Upon termination, your right to access the Service ends; we will provide a reasonable window to export Your Data before deletion, except where legal obligations require earlier deletion or longer retention.
12. Governing Law
These Terms are governed by the laws of Nepal. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the courts of Kathmandu, Nepal.
13. Changes to These Terms
We may update these Terms from time to time. Changes take effect when posted on this page with a revised date. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
